📜TONSquare Access Key Agreement
This document, referred to as the TONSquare Access Key Agreement ("Agreement"). By participating as a Node Supporter, you acknowledge that you have read & agreed to the terms and condition below.
Key Points
Eligibility:
You must be at least 18 years old or the legal age of majority in your jurisdiction.
Participation may be subject to jurisdictional restrictions.
Know Your Customer (KYC):
You may be required to undergo KYC verification to ensure compliance and network security.
Accurate information is crucial for participation.
Node Operation:
Specific hardware, software, and network requirements must be met.
TONSquare Keys are mandatory for node activation and reward eligibility.
Securely manage your Keys and wallet credentials.
Network Rewards:
Earn $TOS tokens for contributing to the TONSquare network.
Rewards are based on factors like Key count, Key Tier, node uptime, and network health.
Prohibited Activities:
Fraudulent activities, illegal actions, unauthorized access, and collusion are strictly prohibited.
Detailed Terms and Conditions
1. Introduction
This Agreement outlines the responsibilities and expectations associated with operating a node within the TONSquare network. By participating, you acknowledge and agree to be bound by these terms and conditions.
2. Eligibility
2.1 Age Requirement: You must be at least 18 years old or the legal age of majority in your jurisdiction, whichever is higher, to participate as a Node Operator.
2.2 Jurisdictional Restrictions: TONSquare is subject to various legal and regulatory requirements. You must ensure your participation complies with applicable laws and regulations in your location, including sanctions and restricted jurisdictions.
3. Know Your Customer (KYC)
3.1 Verification Process: To maintain network security and comply with regulatory requirements, TONSquare may implement a KYC process to verify your identity. This may involve submitting valid identification documents and providing additional information as requested.
3.2 Information Accuracy: Providing accurate and truthful information during the KYC process is crucial. Failure to do so may result in disqualification from the Node Operator program and potential legal consequences.
4. Node Operation
4.1 Technical Requirements: To effectively operate a TONSquare node, you must possess the following:
Hardware: A computer with sufficient processing power, RAM, and storage capacity to run the TONSquare node software.
Network: A stable and reliable internet connection with adequate bandwidth to support node operation.
Software: The latest version of the TONSquare node software installed and running on your computer.
4.2 TONSquare Keys:
Mandatory Requirement: Owning at least one (1) TONSquare Key is mandatory to participate as a Node Operator and earn Network Rewards. These non-transferable Keys are unique NFTs and must be purchased using TON currency. The cost of each Key is dynamically adjusted based on each Tier of Keys and other economic factors.
Key Registration: You must register your TONSquare Keys with the designated TONSquare Node Operator portal to activate your node and begin earning rewards.
Key Security: You are solely responsible for the security of your TONSquare Keys. Maintain strict confidentiality of your private keys and never share them with anyone.
4.3 Wallet Connection:
Wallet Integration: Connect your preferred EVM Wallet with TONSquare to complete the registration process and receive Network Rewards earned through node operation.
Wallet Security: You are responsible for the security of your wallet, including credentials, private keys, and seed phrases. TONSquare does not provide wallet software or store sensitive wallet information. Third-party wallet providers' terms and conditions apply to your wallet usage.
5. Network Rewards
5.1 Reward Distribution: As a Key Holder, you are entitled to receive Network Rewards in the form of $TOS tokens and other incentives. These rewards acknowledge your contribution to the security and decentralization of the TONSquare network. The amount of rewards you receive depends on several factors, including:
Number of TONSquare Keys registered
Uptime and performance of your node
Overall health and activity of the TONSquare network
5.2 Bridge Fees and Gas Sharing: Key holders earn a portion of the bridge fees from cross-chain transactions and a share of gas fees collected on the network.
5.3 Minting $TOS: Rewards in the form of $TOS tokens are dynamically updated based on minting speed. The earlier you join, the greater the rewards you'll receive.
5.4 Airdrops: Airdrops may be conducted for eligible TON holders and node operators as part of the reward distribution.
6. Prohibited Activities
6.1 Fraudulent Behavior:
Any actions intended to deceive or defraud within the TONSquare ecosystem, such as identity theft, impersonation, or falsifying information, are strictly prohibited.
TONSquare maintains a zero-tolerance policy toward such behavior and will pursue legal action where necessary.
6.2 Non-Compliance with Legal Regulations:
Node Operators are required to comply with all local and international laws applicable to their jurisdiction.
Participating in activities that contravene these laws will result in immediate action from TONSquare.
6.3 Unauthorized System Access:
Unauthorized attempts to access TONSquare's systems, networks, or infrastructure are prohibited.
Any interference with TONSquare's operations or compromising of its security will be dealt with as a serious violation of this Agreement.
6.4 Manipulation and Collusion:
Collaboration between participants to manipulate the TONSquare Node Operator program for personal gain or to gain an unfair advantage is strictly forbidden.
TONSquare reserves the right to disqualify individuals involved in such actions and may pursue further penalties.
7. Disclaimer of Liability
7.1 Limitation of Liability:
TONSquare disclaims any and all liability for direct, indirect, incidental, consequential, or punitive damages arising from or related to your participation in the network as a Node Operator. This includes, but is not limited to, loss of profits, data, or goodwill resulting from your use of TONSquare services or inability to use them.
7.2 Third-Party Liability:
TONSquare is not liable for any third-party claims or damages that arise from actions undertaken by Node Operators, including the breach of this Agreement or any other misuse of TONSquare services.
8. Indemnification
As a Node Operator, you agree to indemnify and hold harmless TONSquare, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses arising from your participation in the network. This includes reasonable attorney fees related to:
A breach of this Agreement.
Violation of any applicable laws or regulations.
Third-party claims resulting from your activities in the network.
9. Modification of Terms
9.1 Right to Amend:
TONSquare reserves the right to modify or amend the terms of this Agreement at any time, with or without prior notice. Modifications will be effective upon their posting on the TONSquare platform.
9.2 Notification of Changes:
TONSquare will strive to notify Node Operators of significant changes to this Agreement. However, it remains the responsibility of Node Operators to regularly review the terms for any updates.
9.3 Continued Participation:
Your continued participation in the TONSquare network after any modifications to this Agreement constitutes acceptance of the revised terms.
10. Termination of Agreement
10.1 Termination by TONSquare:
TONSquare reserves the right to terminate this Agreement and revoke your Node Operator privileges if you violate the terms or engage in any activity detrimental to the TONSquare network.
10.2 Effect of Termination:
Upon termination, you must cease all operations within the TONSquare network. Any accumulated rewards that have not been claimed will be forfeited, and you will lose access to all associated benefits.
10.3 Appeal Process:
In the event of termination, you may appeal the decision by providing relevant evidence to TONSquare’s compliance team. TONSquare reserves the right to make the final decision regarding the termination appeal.
11. No Financial Advice
TONSquare does not offer financial, investment, tax, or legal advice to participants. All participants should consult their own advisors regarding their specific financial situation.
Participating as a Node Operator in the TONSquare network involves inherent risks, including but not limited to, fluctuations in cryptocurrency values. By participating, you acknowledge and accept these risks.
12. Miscellaneous
12.1 Entire Agreement:
This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements, communications, or representations.
12.2 Governing Law:
This Agreement is governed by the laws of the jurisdiction where TONSquare is incorporated, without regard to its conflict of law principles.
12.3 Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
